Jeffrey Williams has prevailed on behalf of his client in one of the first significant same-sex child custody cases of its type in the Commonwealth of Pennsylvania.
Williams' client, Andrea Troy, lived with her partner, Denise Juliano, for 10 years until their split in 2001. During their relationship, they planned Juliano's 1996 artificial insemination to become parents to a daughter, Ashley, who was born in 1997.
The couple selected the sperm donor together, attended the birth together, and planned to raise the child together. After the split, Troy sought partial custody of the child, even though she is not the biological mother.
This week, a court ruled that Troy should, indeed, have custody of the child, with the judge noting that, “This case is not about who loves the child more. This case is about ... whether or not Andrea Troy performed and accepted the duties of a parent and was encouraged to do so by [her partner]..."
